Thank you for visiting our BAGGYLUXE e. U. online marketplace for reloved luxury handbags. The protection of your privacy is very important to us. Below we inform you in detail about the handling of your data.
Subject of this privacy information
This privacy policy informs users about the nature, scope and purpose of the collection and use of personal data by this website. Personal data is all data that can be related to you personally, such as name, address, e-mail address, data about your device or your usage behavior on our website. The legal basis for data protection can be found in the Austrian Telecommunications Act (TKG) and Data Protection Act (DSG).
Handling of personal data
We attach great importance to the protection of your data. In order to fully inform you about the use of personal data, we ask you to take note of the following data protection information. Personal data that you submit electronically on this website, such as your name, e-mail address, address or other personal details, will only be used by us for the stated purpose, stored securely and only passed on to third parties if this is permitted by law or the user consents to the collection of the data. BAGGYLUXE e. U. uses personal data for communication purposes. The provider automatically collects and stores information on the web server such as the browser used, operating system, referring page, IP address, time of access, etc.. This data cannot be assigned to a specific person without checking other data sources and we do not evaluate this data further as long as there is no illegal use of our website.
Form data and comments
When website visitors leave comments or form entries, the data entered and their IP addresses are stored. This is done for security purposes in case someone writes unlawful content (insults, left- or right-wing extremist propaganda, hate postings, etc.). In this case, we are interested in the identity of the author.
Contacting
When contacting BAGGYLUXE e. U. (for example, via contact form, chat, e-mail, telephone and sales inquiry), the user's details are stored for the purpose of processing the inquiry and in the event that follow-up questions arise.
Commission
By accepting the offer we send you to sell your bag on commission, a contract must be created with your personal data. These are used because we have a legitimate interest in making this consignment business safe and as uncomplicated as possible, since the ownership of this bag is yours.
Newsletter
We will be happy to inform you regularly about our current offers by e-mail. For this purpose you can subscribe to our newsletter. If you subscribe to it, we will provide you with info about our bag variety, current and upcoming promotions and offers, contests and surveys. We use your email address to send the newsletter and analyze the use of our newsletter to better tailor it to the interests of our customers and your personal preferences. The registration takes place in a double opt-in process. After registration, you will receive an e-mail asking you to confirm your registration.
Data processing in connection with our newsletter is carried out on the basis of Art. 6 para. 1 lit. a DSGVO. You can revoke your consent to receive this newsletter at any time by confirming the unsubscribe link at the end of a notification. After you unsubscribe, it may take a few hours for technical reasons until the unsubscription is implemented, so in exceptional cases you could receive a final newsletter in the meantime.
Disclosure of data to third parties
We work with payment service providers through which payments for your purchases are processed. During payment, the payment service provider collects and processes personal data that is required for the payment method you have chosen. In this respect, the data protection provisions of the payment service provider selected by you apply in addition. When receiving a payment, we process those data that the payment service provider transmits to us. The processing of payments via service providers occurs on the basis of Art. 6 (1) lit. b) DSGVO. In addition, we have a legitimate interest within the meaning of Art. 6 (1) (f) DSGVO to offer our customers the use of suitable and secure payment options. We store payment data until all mutual claims arising from the respective contractual relationship with you have been fulfilled and the retention periods applicable to us under commercial and tax law have expired.
If you select the payment method "purchase on account", we transmit your data to the payment service provider Klarna. Klarna checks and evaluates your information and, for this purpose, exchanges data with other companies and credit agencies (credit check). If your creditworthiness is not guaranteed, Klarna may refuse the selected payment method. Your personal data will be treated by Klarna in accordance with data protection laws and will not be passed on to third parties for advertising purposes. For more information, please refer to Klarna's privacy policy.
We transmit the delivery address provided by you as well as your e-mail address and telephone number to the respective shipping company for the purpose of delivering the goods and announcing their delivery. The legal basis is Art. 6 para. 1 p. 1 lit b) DSGVO, as we fulfill our delivery obligation from the contract with the shipment, and Art. 6 para. 1 p.1 lit f) DSGVO, as we have a legitimate interest in making the shipment as uncomplicated as possible for our customers.
Furthermore, for the purpose of billing and accounting, we share data with third parties who are either subject to a professional duty of confidentiality (e.g. tax advisors) or with whom we have concluded an order processing agreement.
Integration of third-party services and content
It may happen that third-party content, such as videos from YouTube, maps from Google Maps, RSS feeds or graphics from other websites, are integrated within this online offer. This always requires that the providers of this content (hereinafter referred to as "third-party providers") are aware of the IP address of the user. Without the IP address, they could not send the content to the browser of the respective user. The IP address is therefore necessary for the display of this content. BAGGYLUXE e. U. endeavours to only use content whose respective providers only use the IP address to deliver the content. However, we have no influence if the third-party providers store the IP address, e.g. for statistical purposes. Insofar as BAGGYLUXE e. U. is aware of this, BAGGYLUXE e. U. will inform users of this.
Transfer to third countries
We use the store system of Shopify, a Canadian provider. The EU has issued an adequacy decision for data transfers to Canada. There is an order processing agreement between BAGGYLUXE e. U and Shopify, which stipulates that Shopify may not use the data for its own purposes.

Google reCAPTCHA
We use "Google reCAPTCHA" (hereinafter "reCAPTCHA") on our websites. The provider is Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google").
The purpose of reCAPTCHA is to check whether data entry on our websites (e.g. in a contact form) is made by a human or by an automated programme. For this purpose, reCAPTCHA analyses the behaviour of the website visitor on the basis of various characteristics. This analysis begins automatically as soon as the website visitor enters the website. For the analysis, reCAPTCHA evaluates various information (e.g. IP address, time spent by the website visitor on the website or mouse movements made by the user). The data collected during the analysis is forwarded to Google.
The reCAPTCHA analyses run entirely in the background. Website visitors are not informed that an analysis is taking place.
The data processing is based on Art. 6 para. 1 lit. f DSGVO. The website operator has a legitimate interest in protecting its web offers from abusive automated spying and from SPAM.
